The Bombay High Court, under Justice Manjusha Deshpande, has garnered attention after ordering the release of a minor involved in a fatal Porsche car crash, sparking strong emotions and pleas of understanding from the victims’ families. The court’s decision to release the teenage boy, who was reportedly driving the luxury car at the time of the accident, has raised concerns and sentiments of grief and loss. The tragic incident occurred in the early hours of May 19 in Pune, claiming the lives of Ashwini Koshta and her friend Anish Awadhiya, both IT professionals from Madhya Pradesh. The collision, which took place in Kalyani Nagar, resulted in the untimely deaths of the two individuals.
The division bench of Justices Bharti Dangre and Manjusha Deshpande of the Bombay High Court made the ruling to release the minor from an observation home. This decision came after noting that the Juvenile Justice Board’s remand orders were deemed illegal and passed without jurisdiction. The court’s order placed the child in the care and custody of Mamta Koshta, the mother of one of the deceased victims, Ashwini Koshta.
Mamta Koshta expressed shock at the news of the court’s decision, emphasizing the need for justice to be served and for the public to trust the judicial system. While acknowledging the judiciary’s authority, she pleaded with the judges to consider the pain of a mother who has lost her daughter and to ensure that appropriate punishment is meted out in such cases. The mother’s heartfelt plea and the court’s resolution have highlighted the complexities and emotional toll of legal proceedings in cases of tragic accidents.
In response to the court’s decision, Maharashtra Chief Minister Eknath Shinde met with the families of the victims, assuring them of the government’s commitment to ensuring justice in the matter. Despite the HC’s grant of bail to the accused juvenile, Shinde presented a cheque of Rs 10 lakhs to the victims’ families from the Chief Minister’s Relief Fund, reaffirming the state’s dedication to addressing the tragic incident and providing support to those affected.
