On July 3, 2024, the Delhi High Court dismissed an appeal against an earlier order rejecting a man’s plea for disqualification of the candidature of Prime Minister Narendra Modi from the Varanasi constituency in the recently concluded Lok Sabha elections. The appellant, Captain Deepak Kumar, alleged that PM Modi and his accomplices attempted to destabilize the internal and national security of India, causing a fatal crash of an Air India flight in 2018 of which he was the pilot. However, the court found the allegations to be vague, unsubstantiated, and lacking in credibility. The division bench stated that the appellant’s petition was replete with unsubstantiated, disjointed, scandalous, and preposterous allegations. They further mentioned that if the appellant was not suffering from hallucinations, he may be conjecturing facts and needs medical help. Despite the appellant’s insistence that he was well, the court directed local authorities to keep a watch on him. The court emphasized that the petition contained allegations that were incomprehensible and lacked any material particulars, leading to its dismissal. The division bench upheld the single judge’s decision, emphasizing the incoherence and lack of credibility in the allegations presented. The plea included accusations against the PM, Home Minister, and Union Minister of Communication for taking false oaths of allegiance and attempting to kill the appellant. The court concluded that the appeal was a product of the appellant’s imagination and lacked any factual basis or material evidence. This decision highlights the importance of substantiated claims and coherence in legal petitions.
