In a recent development, the Karnataka High Court has granted anticipatory bail to Bhavani Revanna, the mother of rape-accused Prajwal Revanna, a former MP of Hassan. This decision comes in the backdrop of an abduction case linked to the sexual assault allegations against her son.
The High Court of Karnataka provided regular anticipatory bail to Bhavani Revanna in the case of the alleged abduction of one of the victims of her son’s sexual assaults. Justice Krishna S. Dixit passed the order in response to Ms. Bhavani’s petition seeking anticipatory bail.
The court noted that there is no substantial evidence against the petitioner to attract the provisions under Section 364A of the Indian Penal Code. The victim did not provide any statements against Ms. Bhavani either to the police or judicial magistrate. The court further emphasized the importance of upholding the fundamental guarantees of freedom and liberty enshrined in the Constitution.
Addressing the Special Investigation Team’s claims, the court expressed skepticism regarding the necessity of custodial interrogation. It highlighted the lack of substantiation for the SIT’s arguments and emphasized that an accused has the right to respond to questions as per their understanding and should not be coerced into providing specific answers.
Moreover, the court underscored the significance of considering the societal impact of media trials involving women accused in criminal cases. It urged the media to exercise restraint in reporting such sensitive cases to safeguard the integrity of the legal process and prevent premature conclusions.
This significant decision by the Karnataka High Court to grant anticipatory bail to Bhavani Revanna sheds light on the complexities surrounding the ongoing sexual assault case and underscores the importance of upholding principles of justice and fairness in legal proceedings.
