The All India Muslim Personal Law Board (AIMPLB) recently passed a resolution stating their stance against the recent Supreme Court judgment on maintenance of Muslim divorcee women, labeling it as ‘against the Islamic law (Shariah)’. The board authorized its president to explore all possible measures to ensure that this decision is overturned. The resolution came after the Supreme Court ruled that a Muslim woman, who was illegally divorced by ‘triple talaq’, can seek maintenance from her husband under Section 125 of the CrPC, stating that the ‘religion neutral’ provision applied to all married women irrespective of their personal law. During a meeting in Delhi, the AIMPLB emphasized the importance of safeguarding marriage, but also acknowledged divorce as a solution if the marital life becomes unsustainable. The board expressed concerns that the man should not be responsible for maintaining ex-wives when the marriage no longer exists. With authorization from the board, President Hazrat Maulana Khalid Saifullah Rahmani is tasked with initiating measures to ‘roll back’ the Supreme Court’s decision through legal, constitutional, and democratic means. The AIMPLB is also preparing to challenge the Uniform Civil Code in Uttarakhand HC, emphasizing their stance against it as impractical and against the rights of minorities in the country. In addition to the alimony issue, AIMPLB adopted several other resolutions, including one against the UCC, highlighting their legal team’s intent to file a petition later. The board also addressed issues related to the Places of Worship Act, expressing concerns about new disputes related to certain mosques and calling for the implementation of the Act to put an end to conflicts. The resolution on the Palestine issue reaffirmed India’s historical stance of supporting Palestinian rights and called for halting military aid to Israel. Furthermore, the board demanded the government vacate illegally encroached Waqf properties. The AIMPLB’s resolutions also highlighted concerns regarding mob lynching, security for marginalized communities, and the need for upholding constitutional safeguards for minorities.
